Anyone hoping for steamy testimony of Anna Nicole Smith’s alleged lesbian affair with her shrink will be disappointed: The judge in Howard K. Stern’s hearing squelched that topic yesterday, saying, “I’m not going to turn this into some circus sideshow,” the New York Daily News reports. Prosecutors insisted the “evidence of a sexual relationship” shows that Dr. Khristine Eroshevich had reason to keep Smith supplied with pills, but the judge was “not buying this.”

Smith’s bodyguard, Maurice Brighthaupt, was allowed to testify about a near-death experience he says Smith had in October 2006 after taking an “abundance of pills” and chloral hydrate, then falling into her pool and sinking to the bottom. “She scared us to death,” said Brighthaupt, who carried her out of the pool and performed CPR.
